1. Acceptance of these terms
By downloading or using the EMST Timer mobile app or this website (together, the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.
2. The service
EMST Timer is a mobile app that helps you time and guide sessions with an EMST Expiratory Muscle Strength Trainer device. It walks you through your sets and reps, counts down rest periods, cues you to inhale and exhale, lets you rate each rep, and shows you a summary when you're done. We may add, change, or remove features at any time as the app evolves.
3. Your account
You need an account to use EMST Timer, created with an email address and password or by signing in with Google or Apple. You're responsible for keeping your login credentials secure and for all activity that happens under your account. You must be at least 13 years old to create an account.
4. Acceptable use
You agree not to misuse the Service. In particular, you will not:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to our systems or other users' accounts
- Interfere with or disrupt the operation of the Service
- Attempt to reverse-engineer, decompile, or circumvent the app's underlying software
5. Cost
EMST Timer is currently free to download and use, with no in-app purchases or subscriptions. If that ever changes, we'll update this section and let you know in the app before asking you to pay for anything.
6. Your content
Your exercise session data — the sets, reps, and ratings you record while using EMST Timer — is stored only on your device. It's yours; we don't receive it, access it, or claim any rights to it.
7. Intellectual property
The Service, including its design, code, and branding, belongs to Wade Xplorations LLC and is protected by applicable intellectual property laws. These terms don't grant you any rights to our trademarks or branding.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted or error-free.
EMST Timer is a timer and tracking tool meant to be used alongside an EMST Expiratory Muscle Strength Trainer device. It is not a medical device, does not provide medical advice, and is not a substitute for guidance from your doctor, respiratory therapist, or other qualified healthcare provider. Always follow your provider's instructions for using your EMST device, and stop and consult them if you experience any discomfort.
9. Limitation of liability
To the maximum extent permitted by law, Wade Xplorations LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
10. Termination
You can stop using the Service and delete your account at any time — see the data deletion page. We may suspend or terminate your access if you breach these terms, with notice where reasonably possible.
11. Governing law
These terms are governed by the laws of the State of Texas, United States, and any disputes will be resolved in the courts of Texas.
12. Changes to these terms
We may update these terms from time to time. When we do, we'll update the date at the top of this page and, for significant changes, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated terms.
